These Terms of Use ("Terms") govern your access to and use of RetroPals, a personal wellbeing reflection and goal-setting app (the "App"), provided by Retro Scape Ltd, a company registered in New Zealand ("we", "us", "the Developer"; see Section 16). By creating an account, using RetroPals as a guest, or otherwise using the App, you agree to these Terms. If you do not agree, please do not use RetroPals.
1. Acceptance of these Terms
By using RetroPals you confirm that you can form a binding contract with us, that you accept these Terms, and that you agree to comply with them. These Terms apply together with our Privacy Policy.
2. Description of the service
RetroPals lets you complete structured weekly wellbeing reflections, chat with customisable AI companions, set goals and track challenges, and review your trends through analytics. Some features (AI chat/analysis, weather, automatic health sync) are optional and can be turned on or off in Settings. Feature availability may vary slightly by platform (iOS, Android), as described in-app.
3. Eligibility
You must be at least 16 years old to create an account or use RetroPals. By using the App, you represent that you meet this requirement. RetroPals is not directed at children under 16, and we do not knowingly allow their use of the App.
4. Accounts
- You may use RetroPals as a guest (anonymous account) without signing in, or create a full account via Google or Apple Sign-In.
- You are responsible for maintaining the confidentiality of your sign-in credentials and for all activity under your account.
- Guest accounts store data locally on-device only, and may be lost if the App is uninstalled or the device data is cleared, unless upgraded to a full account or saved to a backup file.
- You may link or unlink Google/Apple sign-in providers from Settings → Account.
- You can delete your account at any time in Settings → Account → Delete account, or by following the steps on our Delete Your Account page.
5. Plans, credits and payments
RetroPals is free to use. AI features are optional and are paid for withcredits. You can obtain credits through:
- a Lifetime unlock: a one-time purchase that does not renew and grants a recurring monthly credit allowance, as described in the App at the time of purchase;
- subscriptions: plans that renew automatically each billing period and grant a monthly credit allowance;
- credit packs: one-time purchases of additional credits.
Some plans also include features beyond credits, such as Automatic sync, as described in the App. These can be combined. If you hold a Lifetime unlock and a subscription at the same time, their monthly allowances apply together. We may also grant welcome or promotional credits at our discretion.
Current plans, prices and allowances are shown in the App and on the relevant app store before you buy, and may change over time. A change never affects a purchase you have already made or a billing period you have already paid for. Payments are processed via:
- Apple In-App Purchase and Google Play Billing on iOS and Android respectively, managed through RevenueCat.
Subscriptions renew automatically at the end of each billing period unless cancelled before renewal, in accordance with the applicable app store's subscription management tools. Refunds are handled according to the policies of the Apple App Store or Google Play Store, as applicable to your purchase. We do not directly process refunds for purchases made through those platforms.
Credits are a virtual, in-app unit used to pay for AI usage within RetroPals. Credits:
- have no cash value outside the App and cannot be redeemed for money;
- are non-transferable between accounts;
- are consumed based on the AI model tier used for a given chat or analysis request;
- from a monthly allowance, refresh at the start of each allowance period and do not carry over; credits from credit packs do not expire while your account exists;
- are, unless required otherwise by law or applicable store policy, non-refundable once used.
6. Bring Your Own AI (BYO AI)
If you hold a Lifetime unlock or an active subscription, you may connect your own OpenRouter API key and use it, instead of credits, to power AI chat and analysis. BYO AI is not sold as a separate plan, and it is available only while you hold an eligible plan. If you use BYO AI:
- you are responsible for your own OpenRouter account, any charges billed to you by OpenRouter or your chosen model provider, and compliance with their terms of service;
- your key is encrypted and stored server-side and is used only to make AI requests on your behalf. See our Privacy Policy for details;
- you should keep your API key secure and notify us if you believe it has been compromised;
- you can disconnect your key at any time, which deletes it from our servers;
- we are not responsible for the availability, pricing, or output of models you access through your own key.
7. AI features and wellbeing disclaimer
Not a substitute for professional care
RetroPals' AI companions and AI-generated analysis provide general, non-clinical wellbeing support: encouragement, reflection prompts, and pattern observations. They are not a medical device, a mental health service, therapy, or counselling, and they do not diagnose, treat, or provide clinical advice for any physical or mental health condition. AI responses may sometimes be inaccurate or incomplete.
If you are in crisis, experiencing a mental health emergency, or need medical advice, please contact emergency services or a qualified professional in your area. Do not rely on RetroPals for this purpose. We select AI models with strong safety guardrails, and by default the App only uses AI providers that follow a Zero Data Retention policy. You can choose to turn that setting off to reach other models, in which case the chosen provider's own terms apply (see Privacy Policy, Section 5). You remain responsible for how you use and interpret AI-generated content.
If an AI reply or analysis seems harmful, inaccurate or inappropriate, please report it using the report option in the App. We review reports and use them to improve the safety of AI features.
8. Your content and acceptable use
You retain ownership of the reflections, notes, goals, and messages you create in RetroPals ("Your Content"). By using AI features, you grant us the limited right to process Your Content through our AI integrations solely to generate your requested response, as described in our Privacy Policy.
You agree not to use RetroPals to:
- violate any applicable law or third party's rights;
- attempt to gain unauthorised access to our systems, other users' data, or reverse-engineer the App;
- abuse, overload, or interfere with the AI systems or payment systems;
- impersonate any person or misuse another person's account or API key.
9. Intellectual property
RetroPals, including its design, branding, and underlying software, is owned by the Developer and protected by applicable intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or source code beyond what is necessary to use the App as intended.
10. Third-party services
RetroPals relies on third-party services (including Firebase, OpenRouter and underlying AI model providers, WeatherAPI.com, Open-Meteo, RevenueCat, Apple, and Google) to operate. We are not responsible for the availability, performance, or content of these third-party services, which are governed by their own terms.
11. Apple App Store and Google Play
If you downloaded RetroPals from the Apple App Store, your licence to use the App is granted under Apple'sLicensed Application End User License Agreement (the "Standard EULA"). These Terms apply in addition to the Standard EULA. If the two conflict about your licence to use the App, the Standard EULA applies. You also acknowledge that:
- these Terms are between you and us only, not Apple, and we, not Apple, are solely responsible for the App and its content;
- Apple has no obligation to provide any maintenance or support for the App;
- if the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) of the App to you; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App;
- Apple is not responsible for addressing any claims by you or any third party relating to the App or your use of it, including product liability claims, claims that the App fails to conform to any legal or regulatory requirement, and consumer protection, privacy or similar claims;
- if a third party claims that the App or your use of it infringes their intellectual property rights, we, not Apple, are solely responsible for dealing with that claim;
- you are not located in a country that is subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and you are not on any U.S. Government list of prohibited or restricted parties;
- you must comply with any applicable third-party terms (such as your mobile carrier's) when using the App;
- Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, may enforce them against you.
If you downloaded RetroPals from Google Play, the Google Play Terms of Service also apply to your download and to purchases made through Google Play Billing.
12. Disclaimer of warranties
RetroPals is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement, to the fullest extent permitted by applicable law. We do not warrant that the App will be uninterrupted, error-free, or that AI-generated content will always be accurate.
13. Limitation of liability
To the fullest extent permitted by applicable law, the Developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of RetroPals. Nothing in these Terms limits any liability that cannot be limited under applicable law, including statutory consumer protection rights available to you in your jurisdiction.
14. Termination
You may stop using RetroPals and delete your account at any time via Settings → Account → Delete account, or by contacting us. Deleting your account does not cancel a subscription; cancel it through the App Store or Google Play. We may suspend or terminate access to the App for violations of these Terms, or discontinue the App or specific features, with reasonable notice where practical.
15. Governing law and changes
These Terms are governed by the laws of New Zealand, without regard to conflict-of-law principles, and the courts of New Zealand have jurisdiction over any dispute. This does not take away any mandatory consumer-protection rights you have under the law of your country of residence, including the right to bring a claim in the courts where you live if that law gives you one. We may update these Terms from time to time; continued use of RetroPals after an update constitutes acceptance of the revised Terms. We will update the "Last updated" date above when we do.
